Once again the justice system fails the public.


Once again I have to ask the question, WHY DOES OUR JUSTICE SYSTEM RELEASE PERSISTENT SEX OFFENDERS TO COMMIT THEIR DESPICABLE CRIMES AS SOON AS THEY ARE RELEASED, WHILE NOT EVEN SERVING THE SENTENCE THEY RECEIVED IN THE FIRST PLACE.

How often are they going to be allowed out AND commit their vile offences before the idiots who release them learn that they are not fit to walk our streets.

As I have said before, the idiots who release them should stand trial along with them, for crimes committed against honest upright citizens human rights.

Since the human rights law came out, I know of no honest citizen getting any benefit from it, only the scum criminals who are allowed to exploit it, and should have no human rights whatsoever.

Below I have copied and printed the most recent cause for my concern.

A man has admitted trying to murder a 60-year-old woman in an Aberdeen park amid a plan to abduct and rape her two granddaughters, aged eight and two.

Ryan Yates, 29, stabbed the woman while the children escaped in the Bridge of Don area of the city last October.

Two days before the incident he was put under a court order banning him from accosting females after a sex attack, the High Court in Edinburgh heard.

Sentence was deferred for a full risk assessment order.

Yates carried out the attack five days after he was released from prison for an assault which contained a sexual element.

He was caught by police shortly after the attack and said he had gone out that day "looking to find some children to have sex with".

He said he intended to kill the woman he attacked "so that I can get to the kids".

Advocate depute Alan Mackay said: "While walking in the park the younger child asked to come out of her buggy. The grandmother bent down to unbuckle the child from the buggy and noticed a pair of legs standing very close to her.

"She stood up and saw the accused close by, less than an arm's length away. He was holding a sharp pointed kitchen knife with a serrated edge in his right hand."

He said that, without warning, Yates then thrust the knife towards the woman's chest and during the ensuing struggle the victim found herself on the ground.

She grabbed the bottom of the blade and top of the knife handle and kicked out at her attacker while the elder of the children fled with her younger sister.

'Safety concern'

Mr Mackay said: "The struggle for the knife continued and Yates told her he'd let her go if she let go of the knife. She refused and the accused spat in her face as she continued to struggle and scream."

A woman intervened and Yates walked away "quite calmly".

Police soon tracked him down. During an interview he maintained that he would have had sex with the children despite their ages but would have let them go afterwards.

Mr Mackay said the grandmother was left with a scar on her left hand which served as a constant reminder of the incident.

He said: "When she is out walking now she feels that she is constantly looking over her shoulder.

"She also indicates that she is concerned for her grandchildren's safety."

Unemployed Yates admitted attempting to murder the grandmother with the intention of abducting and raping the young children in Westfield Park on 14 October last year.

He also admitted breaching the terms of an interim sexual offences prevention order made against him at Aberdeen Sheriff Court two days earlier.

The court heard that Yates was sentenced to four years detention in 1994 after being convicted of three charges of indecent assault and two of assault.

He was given a further two-year term of detention in 1999 for an attack on a woman and was given another seven-year extended sentence in 2003 following a High Court conviction for assault containing a sexual element.

'Horrific crime'

Lord Pentland placed Yates, who is in custody, on the sex offenders' register pending the risk assessment report, due in April.

Det Supt Brian Yule, of Grampian Police, said: "This was a horrific crime targeting an innocent woman out for a walk in the park with two young children."

He added: "Grampian Police and its partners are thorough in its application of nationally-set regulations for dealing with registered sex offenders.

"At the time of his arrest, Yates had fully complied with all the conditions relating to his registration and our officers had visited him regularly in the days after his release.

"We and the other partners involved in the supervision of offenders devote considerable resources to this area and we will continue to do so in order to provide the best possible levels of protection to the public we serve."

Yates told police after the attack that he had wanted to be sent back to prison. Officers believe he may have become "institutionalised" after so much time in jail.

Det Supt Yule suggested that politicians could consider the case for new powers, allowing police to seek extensions to prison sentences if offenders fail to comply fully with rehabilitation programmes.

Now why was this man released, and this crime allowed to happen, and nobody in authority held responsible?
They are very good at coming up with groveling apologizes, and excuses AFTER the event, which is far too late and just not good enough!

Rapist freed to rape again days later.

Here is another example of the stupidity in the British justice system.
I am so disgusted that I will post a copy of the story rather than write about it, and give you an idea how our courts here in Britain have no respect for the victims of crime.
Make up your own minds, and tell me if this rapist should ever walk free again,regardless of his age, as it is obvious to me that on his release he will waste no time until he finds his next victim.
Any judge who released or, releases this scum in the future should be sacked, and never allowed to sit on any bench in our courts again.
Its long past the time when we should be demanding justice,and protect our general public.

Judges follow sentence guidelines

A teenager who kidnapped and raped a five-year-old boy, eight days after avoiding custody for another rape, has been detained for at least three years.

The 16-year-old admitted offences against the second boy including rape and child abduction.

Manchester's Minshull Street Crown Court heard the attack happened after he was given a community order for the rape of a boy aged seven in Tameside.

The first sentence, by Judge Adrian Smith, provoked a legal challenge.

On Wednesday, the attacker, who cannot be named, was given an indeterminate sentence for protection of the public after committing a second attack.

'Deeply disturbing'

He must serve a minimum of three years minus five days before being considered for parole.

But Judge Peter Lakin told him: "The offences you have committed are deeply disturbing and very serious.

"You are a devious and manipulative young man with an unhealthy and completely unacceptable sexual interest in young boys.

"It is likely you will not be released for some very considerable period of time."

He added that it was "highly unusual" for a court to categorise a 16-year-old as a danger to the public but in this case it was merited.

"I have to say I have absolutely no hesitation whatsoever in reaching the conclusion that you are indeed a dangerous offender," the judge said.

The boy was sentenced to three years and four months, but will be eligible for parole earlier because of time spent in custody.

Appeal bid

Judge Lakin also revoked the community rehabilitation order passed by Judge Adrian Smith and resentenced him for the earlier rape offences against the seven-year-old.

He was sentenced to three years and four months, to run concurrently, and placed on the Sex Offenders Register.

In sentencing for the first rape, Judge Smith is believed to have considered the victim's family, who forgave the youth because of their Christian beliefs.

The three-year community order led to an appeal by the Crown Prosecution Service (CPS), but was overtaken when, just days after appearing in court, he was arrested for the second rape.

On 4 July 2009, the second victim, who is now six, was playing outside near his home when he was lured away to look for a lost football but was actually taken to the teenager's house and abused.

He was found emerging from the house while his parents searched the neighbourhood for him.

The teenager later admitted child abduction, rape, committing an offence with the intention of committing a sexual offence, attempted rape and causing a child to engage in sexual activity.

Speaking after the hearing, Det Con Terry Farrell, who led the investigation, said it was a "harrowing and disturbing" case.

"Rape is rape and whether you are 16 or 60, it is one of the most horrific crimes anyone can commit. For this to happen to a five-year-old boy is beyond comprehension."

He then went on to read a statement on behalf of the father of the victim.

He said: "This has been a traumatic ordeal for my whole family, and particularly for my six-year-old son who has had to go through what no-one, let alone a young innocent boy, should ever have to go through.

"It has been a harrowing time but I'm glad it is finally over and we can now draw a line under everything and move on with our lives."

Its all very well having a christian attitude,but if the parents of his first victim had not wanted leniency, the other poor victim and family would not have had to suffer the same atrocities plus the pain and suffering that goes along with it. .
They should be regretting that christian decision now, and have some thought for future victims.

Lawyer Ann Ogg should hang her head in shame.

Another blunder by our idiotic judges, letting the disgusting sex attacker John Bermingham free to attack some poor innocent person who is unaware at this moment that this sick pervert has been released into our society to attack them, by using a law brought out to protect his victims rather than the vermin that HE is.
When are our courts of justice going to wake up to the fact that these scum should have NO rights as far as HUMAN rights are concerned, because there is nothing human about raping and assaulting young women and girls and putting them through horrific ordeals that will linger in their memories for life..........if they survive.
Scum like him should be locked away for life with no reprieves under any circumstances, and by doing so, WILL save MANY others from suffering.
When his next victim is attacked and they prove HE was to blame, let the idiotic judges who let him out to reoffend spend time in jail too, and on their release never let them have anything more to do with justice as they obviously have no idea what JUSTICE really means.
The lawyer Ann Ogg, who fought for his release, should hang her head in shame, because the normal people in the street whom she faces every day will feel disgust at her deed, and would gladly see her face a prison sentence when Bermingham's next victim comes to light.
As I repeat frequently in this blog, "CRIMINALS HAVE NO RIGHT TO THE HUMAN RIGHTS LAWS." THESE LAWS WERE INTRODUCED TO PROTECT THE INNOCENT."
WAKE UP YOU STUPID POLITICIANS AND SO CALLED JUSTICE MINISTERS AND GET THIS LAW SORTED SO IT CARRIES OUT THE JUSTICE IT WAS INTRODUCED FOR, OR PAY THE PRICE YOURSELVES.
